In recognition of the number of residents in nursing facilities and the potential for abuse and neglect, the state of Illinois passed the Illinois Nursing Home Care Act, which defines the residents’ rights, including, but not limited to, the right to:

  • Be free from abuse or neglect
  • Manage their own finances
  • Have their own clothing and belongings
  • Free from restraints unless ordered by a physician
  • Have access to their medical records
  • Have visitors, mail, and phones

In addition to this act, nursing homes are also subject to federal laws protecting their residents. Despite these legal protections, abuse still occurs, and can result in serious injuries or death. The IDPH investigates approximately 6,000 complaints each year, including:
