It is very unusual that a negligent or incompetent doctor leaves a foreign object, such as a scalpel or sponge, inside of your body without your knowledge, but it does happen. And it can be devastating. The good news is that the clock to bring a medical malpractice action against this negligent doctor, the nurses who assisted him and the hospital where the procedure took place does not start to run until you are aware of the negligent act or omission. Once you become aware, you then have two years to bring the medical malpractice legal claim against the doctor, nurse and hospital in a local Chicago trial court.  The bad news is that you may not become aware of the malpractice for a long period of time and Illinois law prohibits claims against doctors, nurses and hospitals four years after the act or omission took place regardless of whether you were aware of the malpractice.

The two years do not start counting until you become aware of the malpractice. For example, if a doctor leaves a needle inside you, the needle can be there for years without causing you any discomfort or pain that would prompt you to believe something is inside your body. A needle can move throughout your body, abdomen and chest for a long period of time before you ever realize that you have a foreign object lodged inside of you. Contrast that with a sponge in your abdomen or dye injected into your spinal column, which more than likely will immediately cause a lot of pain and discomfort. The sponge is something that is more likely to be discovered within Illinois four-year statute of repose. However, a needle can be hidden for many years after the Illinois statute of repose has run.  Attorney Dan Newlin and his experienced team of Chicago medical malpractice attorneys have proudly recovered over 150 Million Dollars for injury and accident victims.  Attorney Dan Newlin and his team of experienced medical malpractice lawyers will fight for you!

Consider a New Hampshire case where a woman’s treating doctors committed malpractice while delivering her child by failing to take out the entire placenta when the child was born. This negligent act led to the woman needing a hysterectomy and during that procedure the same doctors committed another negligent act by leaving a surgical sponge inside her. The sponge then caused a severe infection and the woman died as a result of the malpractice.

Throughout this entire episode, the woman continued to be treated by the same doctors who hid the malpractice. Ultimately, her family brought a wrongful death claim and the doctors’ lawyers argued that the case should be dismissed, as the statute of limitation and repose had expired. The court ruled against the doctors and allowed the action to go forward under the exception to the rule because the patient’s confidence in her doctors led her to continue under their care. If you have questions about your medical malpractice case call Attorney Dan Newlin now for a free consultation at 312-888-8000. Doctors cannot defend medical malpractice claims on the basis that the patient should have known to consult another doctor when the patient places her trust in the treating doctor who committed the malpractice. The patient looks to that doctor as the expert and expects that doctor to act with her best interest in mind.
