Cancer Misdiagnosis

The key to successfully fighting cancer is early detection. Due to improvements in cancer treatment, early diagnosis can now lead to successful treatment of many types of cancer. Unfortunately, if the cancer is not diagnosed until it reaches a late stage, the prognosis is not as positive. Misdiagnosis and late diagnosis of cancer is a deadly error that should never happen.

With so many sophisticated diagnostic tools at their disposal today, such as mammograms, MRI’s, CAT/CT scans and biopsies, Chicago doctors should rarely, if ever, fail to correctly diagnose a patient’s cancer; and do so in a timely manner while the disease may still be treatable. But the frightening facts remains that while last year more than 300,000 men and women were diagnosed with either prostate cancer, ovarian cancer, cervical cancer, breast cancer and malignant melanoma (skin cancer), there were thousands of patients whose cancer went undetected, or detected too late, and suffered the devastating consequences, because of the medical negligence, or errors made by doctors, and/or by a pathologist who misread a biopsy, or by a radiologist who misread the films from a scan. Not only were the patients’ lives destroyed, but spouses and children of the patients very often lost the emotional, and financial support, they depend on in their everyday lives.

Cancer symptoms can share the characteristics of other conditions, so proper testing by Chicago doctors is essential. Tests such as the PSA test, mammograms and biopsies are commonly used by the Chicago medical profession to detect cancer. Many times Chicago doctors fail to even order these crucial tests. There are also situations where the proper tests are ordered, but the Chicago radiologist misreads the film or the Chicago pathologist misreads the slide, leading to a crucial delay in making the diagnosis. Delay in diagnosing cancer can worsen the treatment or prognosis or can even be fatal.
I have years’ worth of experience representing plaintiffs who have been injured or have died as the result of medical malpractice involving failure to diagnose cancer, including cases involving:

  • Breast cancer
  • Ovarian/cervical cancer
  • Colon cancer
  • Lung cancer
  • Skin cancer (melanoma)
  • Prostate cancer
  • Thyroid cancer
  • Leukemia
  • Lymphoma
  • Uterine cancer
  • Testicular cancer
  • Stomach cancer
  • Rectal cancer
  • Bladder cancer
  • Kidney cancer

My team includes a board-certified physician and a professional registered nurse who can assist in reviewing your case and help you to understand the full medical scope of your claim. My firm conducts exhaustive investigations, and I retain the most qualified experts to bring a comprehensive level of expertise to surpass that on the other side. For example, when a doctor fails to diagnose breast cancer, I seek out and retain a practicing breast cancer specialist to determine the full circumstances of the misdiagnosis and in the event of a misread mammogram, we will find an expert radiologist to examine the films.

I have years’ worth of experience examining, preparing and presenting complicated medical evidence. I work closely with medical experts, such as doctors, nurses, nurse practitioners, pharmacists and therapists throughout the legal process. If necessary, I can also retain expert accountants and financial analysts because many medical malpractice cases have their own set of associated losses including lost wages, the cost of care and many other monetary costs. I do this in order to accurately assess what these costs will be for the remainder of a victim’s life, we use financial professionals to derive fair resolutions for our injury victims. It is through this coordinated effort that I have consistently obtained record breaking awards and settlements and obtained hundreds of millions of dollars for my injured clients.

If you or a family member have suffered a personal injury as a result of medical malpractice, negligence or carelessness of a Chicago doctor or other Chicago health care provider, you may be entitled to monetary compensation. If you or a loved one who have been injured as the result of medical malpractice involving failure to diagnose cancer, please contact me at (312) 888-8000 to learn more about your legal rights.
