Personal Injury Protection (PIP)
Florida state law requires every driver to carry Personal Injury Protection (PIP) coverage on their insurance policies. This coverage provides for up to 80% of your medical bills (up to $10,000). In addition, PIP pays a portion of lost wages and also helps cover mileage reimbursements to and from medical facilities for as long as you receive treatment for the injuries sustained during the accident.
Uninsured Motorist Coverage
If you don’t have PIP, you may still be able to receive benefits from the at-fault driver’s insurance. If the at-fault driver does not have insurance, you should be able to file a claim against your Uninsured Motorist Coverage. This can be done using either your insurance policy or the policy of a family member you live with.
Repair or Replacement of my Bike
Just like an accident involving multiple cars, if you are struck by a car while riding a bike, you are entitled to a replacement or repairs. Items such as bicycles are considered property, and insurance covers damage to property.
If it’s determined that the driver of the car was at fault, and that driver carries insurance, the at-fault driver’s insurance company should compensate you for the repair, or for the replacement of your property.
Make sure you document the accident by taking quality pictures of both the damaged property and the scene of the accident. Make sure to include pictures of any impediments that may have contributed to the accident.
